These Terms and Conditions (which include terms relating to Payment & Shipping) govern the use of sportingoutbacksupplies.com.au and gundogsupply.com.au ("website"), and the purchase of any goods from it.

Acknowledgment and acceptance of Terms and Conditions

Please note that by accessing, using or browsing this website you agree to be bound by its terms, conditions, disclaimers and limitations of liability (Terms and Conditions). Sporting Outback Supplies reserves the right to amend or update such terms, conditions, disclaimers and limitations of liability at any time without providing notice to you. By using the website, you acknowledge that you have read and understood these Terms and Conditions.

Purchase of knives

Please note that Sporting Outback Supplies have a strict policy only to sell knives to persons over the age of 18 years, and that by ordering and purchasing knives from Sporting Outback Supplies you warrant that you are over the age of 18 years and agree that you understand the rules and regulations in relation to knives in your own state or territory.

Limitation of Liability

Subject to any non-excludable liability for breach of conditions or warranties implied by legislation, any liability of Sporting Outback Supplies or Sporting Outback Supplies' Associates (principals, agents and employees) in connection with goods or services supplied to the customer ("you") will be limited to the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods.

Product Information

Prices of goods and services and delivery and other charges displayed on the website are current at the time of display. These prices are subject to variation without notice. We will always attempt to be as accurate as possible with our product descriptions and pricing. However, we are unable to warrant that product descriptions or other content of the website is accurate, complete, reliable, current or free of errors.

Placing and Accepting Orders

Orders will not be despatched until payment in full has been received and Sporting Outback Supplies is satisfied with the integrity of the order.

It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense. It is the responsibility of the customer to inform Sporting Outback Supplies if an order does not arrive. Once we learn an order has not arrived by the due date, we will lodge enquiries with Australia Post or the relevant courier company to ensure delivery occurs as soon as possible.

Without limiting the operation of any other Terms and Conditions herein, Sporting Outback Supplies is not responsible for any loss or damage resulting from late delivery. Placement of an order by you constitutes an offer to enter into an agreement with us ("your offer"). We may email you an Order Confirmation for the sole purpose of confirming the details of your offer. Our Order Confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.

If an item has been lost in transit, we may not despatch a replacement item immediately. Replacement items will be despatched according to our discretion.

Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order. Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

Returns and Exchange Policy

All items unless specified are brand-new and sent in original packaging. Ensuring that our customers are 100% satisfied is of the utmost importance to us. If you are in any way dissatisfied with the product you have received, we will gladly exchange the product for an item of the same value, or you may purchase an item of a higher value and pay the difference. Any exchanges need to be notified and returned to us within 14 days of the date of delivery. All returned items must be returned to us in its original and saleable condition. Boots and clothing must show no sign of having been worn. Excluding faulty items, the postage costs of returned and replacement items are the responsibility of the purchaser.

If you want to return a product to us for an exchange, you can do so through Australia Post. Simply place the returning item in an envelope, satchel or box suitable for mail or courier transport with an explanation why the product is being returned and post to:

To complete an exchange, please include with the item a note detailing the name, variety and cost of the new product you require. If there is a difference in the price of the products involved in the exchange, please tell us how you would like to pay the difference.

We do not usually accept a return of products for a 'change of mind'. However, if we do exercise our discretion to accept a return of any product for your change of mind, a re-stocking fee of 15% will be deducted from the refund of the cost of the returned item. For the avoidance of doubt, postage costs of the product originally ordered and of the returned items are the responsibility of the purchaser.

Representation of Age

Sporting Outback Supplies has a strict policy only to sell knives to persons over the age of 18 years. When you place your order and purchase knives from Sporting Outback Supplies, you represent that you are over the age of 18 years and can legally purchase those knives in your city, state or territory. Sporting Outback Supplies' offer to sell knives does not imply, warrant or present that any specific purchaser may legally purchase, own or possess the knives ordered.

Indemnity and Release

When you purchase products from Sporting Outback Supplies you agree to indemnify and hold Sporting Outback Supplies and its Associates (principals, agents and employees) harmless from any and all claims brought by any person or entity against Sporting Outback Supplies related to and/ or arising from your ownership and use of the products, and you agree to assume all risk related to and/ or arising from your ownership and/ or use of the products. Knives may be dangerous if used illegally, improperly or negligently. When you purchase those products from Sporting Outback Supplies you agree to use the products in a legal and safe manner in accordance with all applicable laws, common sense and safety rules.

Privacy

We treat all customer information in accordance with our Privacy Policy. Our Privacy Policy constitutes part of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws in force in New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts, which may hear appeals from those courts.
